1. Introduction
These Terms and Conditions ("Terms") govern your use of FixedRecruit's services, website, and any other related applications or platforms (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Services.
2. Service Description
FixedRecruit provides fixed-fee recruitment services for businesses seeking to hire qualified candidates. Our Services include job advertising, candidate sourcing, screening, shortlisting, and presentation of qualified candidates for a flat fee of $1,500 AUD per successful hire.
3. Service Agreement
3.1 Recruitment Process
Upon engagement of our Services, FixedRecruit will:
- Create and publish job advertisements on relevant platforms
- Source and screen potential candidates
- Conduct initial assessments of candidates
- Present a shortlist of qualified candidates within 7 business days
- Facilitate the interview process as needed
3.2 Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about the position requirements
- Review candidate submissions in a timely manner
- Communicate promptly regarding candidate feedback
- Pay the agreed-upon fee
- Maintain confidentiality of candidate information
4. Fees and Payment
4.1 Fixed Fee Structure
Our standard fee is $1,500 AUD per successful hire, payable upon acceptance of an offer by a candidate.
4.2 Multi-Hire Packages
For clients requiring multiple hires, we offer a 5-hire package at $1,250 per hire, usable over a 12-month period.
4.3 Payment Terms
Payment is due within 14 days of invoice issuance. We accept payment via electronic funds transfer (EFT) or credit card.
5. Guarantee and Refunds
5.1 Candidate Guarantee
If we are unable to present suitable candidates for your role within the specified timeframe, you may request a refund of $1,000.
5.2 Refund Process
To claim a refund, clients must notify FixedRecruit in writing within 5 business days of the qualifying event. Refunds will be processed within 14 business days of approval.
6. Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, and images, are the exclusive property of FixedRecruit and are protected by Australian and international copyright, trademark, and other intellectual property laws.
7. Confidentiality
Both parties agree to maintain the confidentiality of all information shared during the recruitment process, including candidate details, business information, and proprietary methodologies.
8. Limitation of Liability
To the maximum extent permitted by law, FixedRecruit shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our Services.
Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount paid by you to FixedRecruit in the six months preceding the event giving rise to the liability.
9. Termination
Either party may terminate the service agreement with 7 days' written notice. If termination occurs after candidates have been presented but before a hire is made, a partial fee may apply based on the stage of the recruitment process.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Australia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Adelaide, South Australia.
11. Changes to Terms
FixedRecruit reserves the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms and/or by placing a notice on our website.
